For Dutch stichtingen with employees who travel for work: why the employer must insure work-related traffic accidents, even though no law names this insurance.
Case-law obligation
Under article 7:611 BW (good employership), the Hoge Raad ruled in 2008 that the employer must arrange adequate insurance for employees who take part in traffic as part of their work (see rechtspraak.nl : Maasman/Akzo, ECLI:NL:HR:2008:BB4767 ). Later that year, the Hoge Raad extended this duty to employees who travel for work by bike or on foot (see rechtspraak.nl : ECLI:NL:HR:2008:BD3129 ).
No law names this insurance, but the consequence of skipping it is concrete. If an employee has an accident while travelling for work and the employer has no adequate cover, the employer pays the amount the insurance would have paid out. This applies to travel that is part of the job, such as cycling to a meeting with a partner organization or driving to an event. Regular commuting between home and the office generally falls outside this duty.
How to arrange it
Insurers usually offer this cover as an add-on to the General liability insurance (Aansprakelijkheidsverzekering voor bedrijven, AVB) , often called a verkeersdeelnemersverzekering. When the employer takes out an AVB, the employer checks that this cover is included.
